These Terms of Use (“Terms”) govern your use of this site and related services offered by Denise Voight, MS, Functional Medicine Nutritionist and Founder of My Spectrum Heroes (“I,” “me,” “my,” or the “Company”).

By accessing this site, booking a Biochemical Balance Session, purchasing products or programs, or otherwise interacting with my services, you agree to these Terms. If you do not agree, do not use the site or purchase services.

1. Important health & wellness disclaimer

Information on this site—including educational content, session descriptions, emails, and program materials—is for general educational and informational purposes only. It is not medical advice, diagnosis, or treatment.

• Always consult your physician or a qualified healthcare professional before starting any new dietary supplement, nutrition plan, lifestyle change, or health protocol—especially if you or your child have a medical condition, are pregnant, nursing, or taking medication.
• Nothing on this site or in any program constitutes the practice of medicine, psychiatry, psychology, psychotherapy, or any other licensed healthcare profession.
• Individual results are not guaranteed. Testimonials, case studies, and examples are not indicative of future results. Outcomes depend on many factors outside of my control.

2. Nature of products & services

I may offer:

• Educational sessions, including the Biochemical Balance Session
• Digital products (courses, memberships, downloadable resources)
• Physical products (nutritional supplements under the My Spectrum Heroes brand)
• Consulting and practitioner-guided support
• Functional lab testing recommendations and interpretation (non-diagnostic)

All sales are subject to the refund and access terms shown at the time of purchase. Digital products and program memberships are generally non-refundable after access has been granted, except where required by law.

3. SMS program terms

By providing your mobile phone number and opting in, you consent to receive SMS text messages from Denise Voight. Message types may include:

• Session reminders and booking confirmations for your Biochemical Balance Session
• Assessment completion prompts and follow-up instructions after purchase
• Program update notifications and next-step guidance for enrolled members

Message frequency varies based on where you are in the program experience. Message and data rates may apply. Check with your carrier if you are unsure about your plan.

Carriers are not liable for delayed or undelivered messages. Denise Voight / My Spectrum Heroes is not responsible for delays, delivery failures, or errors attributable to your carrier or network.

4. Intellectual property

All content on the site—including text, graphics, logos, videos, downloadable files, course materials, and program content—is owned by me or licensed to me and protected by copyright, trademark, and other intellectual property laws.

You receive a limited, non-exclusive, non-transferable, non-sublicensable license to access and use the site and purchased products for personal, non-commercial use only. You may not copy, reproduce, distribute, create derivative works from, publicly display, sell, resell, or otherwise exploit content for commercial purposes without prior written permission. Unauthorized use terminates this license.

5. User conduct

You agree not to:

• Share login credentials or course/program access with others
• Copy, record, or redistribute any paid content
• Use the site for any unlawful purpose or in violation of local, state, national, or international law
• Attempt to interfere with the site's security or functionality

I reserve the right to terminate or restrict access to the site, programs, or memberships at any time, with or without cause or notice.

6. Payments & subscriptions

Payments are processed through third-party providers (for example, Stripe, Kajabi, or Shopify). You agree to those providers' terms. Recurring membership fees continue until you cancel through your account settings or by contacting support.

7. Privacy

Your use of the site is also governed by the Privacy Policy. By using the site, you consent to the practices described there, including collection and use of your phone number if you opt in to SMS communications.

8. Third-party links & services

The site may link to third-party websites (lab companies, supplement partners, payment processors, scheduling tools). I am not responsible for the content, accuracy, or practices of those sites.

9. Disclaimer of warranties

THE SITE, PRODUCTS, AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

I do not warrant that the site will be uninterrupted, error-free, or free of viruses or other harmful components.

10. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, I, MY COMPANY, EMPLOYEES, CONTRACTORS, OR AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES—EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES—ARISING FROM YOUR USE OF THE SITE, PRODUCTS, OR SERVICES.

My total liability for any claim shall not exceed the amount you paid me in the preceding 12 months. Some jurisdictions do not allow certain limitations, so the above may not apply to you.

You agree to indemnify, defend, and hold harmless me and my officers, directors, employees, agents, and affiliates from claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your violation of these Terms or your use of the site, products, or services.

12. Governing law

These Terms are governed by the laws of the State of California, without regard to conflict of law principles. Disputes shall be resolved exclusively in the state or federal courts located in Orange County, California.

13. Changes to these terms

I may update these Terms from time to time. The updated version will be indicated by the dates above. Continued use of the site after changes constitutes acceptance of the revised Terms.
